GAAR comedown and FDI comeback: A Sham Revival

The coup de grace of government to countrymen not only ends with awful diesel price hike once again and assailant move of awry cap on cooking gas cylinder but goes further to planned systematic loot through retail FDI to add to the adrenalin and make worse the situation of Aam-admi; already wounded with the adamant and abrupt steps of UPA.http://saurabhnation.blogspot.in/2011/11/tragedy-tale-fdi-in-retail.html

Ignoring the bitter truth and with proven inaction against the CAG revelation of multi trillion crore scam and fraud (Except those unearthed and god knows how many more) with nation, UPA’s alacrity to invite retail giant in India despite the arm-wrestling within allies itself, is genuine to invite aspersions from the mass for the atrocious au Fiat of Indian economy.

In the high time to avow and accept the allegations of corruption and deep rooted fraud in every walk of governance the chastened government seem to be determined to embitter the life of common man by diverting national attention from hanged parliamentary session to hinging on Retail FDI and indecisive price hike on the plea of economic revival .

It’s hard to understand that the govt. step will go ahead to improve economic growth and international grade ratings as said by Mr. Ahluwalia and some other leading businessmen (Read the newspapers today for supportive comments of top industrialists)despite the known fact of failure of retail giant in foreign countries.

Having already existence of certain Specific Anti-avoidance Rules (SAAR) in the IT act namely Section 2 (22)(e),93/94,40 A (2/3),Expln. 3 to Sec 43(1),Clubbing Provision etc ,Finance bill ,2012 proposed insertion of GAAR in the income tax act at par with other countries like Australia,Canada,China ,Singapore, South Africa, New Zealand ,Germany, France ,UK and USA to codify the doctrine of “Substance over form”  for determining the Tax consequences of any transaction ,the real intention of the parties and effect of transactions and purpose of an arrangement to deny the tax benefits of transaction or arrangements which do not have  any commercial substance or consideration other than achieving the tax benefits which constitutes an Impermissible tax avoiding mechanism in the wake of recent famous case of Vodafone & McDowell’s to curb the abuse of India-Mauritius tax treaty.

The expert committee on GAAR (the General Anti-Avoidance Rules) headed by Parthasarathi Shome to address the concerns of foreign and domestic investors, set up by PM MM Singh after he resumed office vacated by Pranab da,has recommended postponement of the controversial tax provision by three years and abolition of capital gains tax on transfer of securities.

In its draft report submitted to the Finance Ministry, which has been put in public domain for a fortnight for comments from stakeholders, the committee advocated that the GAAR provisions should not be invoked to examine the genuineness of the residency of investor entities in Mauritius. 

Roll back of GAAR to attract FDI & FII community, doesn’t seem to be decisive if it is to avoid the consequent Revenue loss through tax avoidance mechanism (Impermissible avoidance arrangements-IAA) as 42 % of FDI in India comes through Mauritius route itself.

If government really wants growth and development of country then why not they move to take quick action to bring back Black money stashed outside the country and disclose name of culprits instead of taking quick decisions of inviting FDI and in fact after bringing back the black money would there be any need more for FDI or the real culprits of government bringing black money through FDI mode?

Subject: Ethnic Cleansing of Original Tribes, Other Hindus & Non-Muslims in Assam & current violence there.

Reference: The ongoing violence in Assam currently.

Hon. Shri President of Bharat,

Nomoshkaar! At the outset, let me wish you congratulations for becoming the 13^thPresident of Bharat – The 1^st Citizen of Bharat. I am sure with your long experience in insight in Bharat, now Bharat will try to solve the problems faced by Bharat’s citizens.

Now, without wasting more time in formalities, I wish to draw you urgent attention & immediate intervention to the gruesome plight that Bharat’s original citizens in Assam have been facing. As you are aware, last few days, Assam is burning. Lakhs of Original Tribals have been attacked & forced to flee their homes, villages & towns. Their homes burnt, their little land grabbed & their loved ones lost in the horrible arson & murders by Bangla Deshi Infiltrators now settled in Assam. The relief camps are pouring with the victims of this Ethnic Cleansing of original citizens of Bharat by the Infiltrators. With your kind sensitive heart, if you see the wrinkled faces & tear-filled eyes of those old tribal women & those young worried nursing mothers holding their new-borns in their hands, you will realize the agony & pain they are going through.

This is not the first time it has happened in Assam. It has been going on for over 2 decades. Karbi Anglong, Khasi, Dimasa, Bodo, Jaintia & many other local Tribes who have made Bharat’s North East eco-friendly with their environmentally simple life styles, who have made Bharat rich with their great art & culture are being brutally attacked, their jungle habitats burnt, their women raped, their men fired at in close range & ultimately they are forced to either die at the hands of Bangla Deshi invaders or leave their age-old traditional habitats.

Unfortunately, just like the authorities ignored first, then neglected & then manipulated the ethnic cleansing in Kashmir done by Pakistan supported separatist groups, the Assam’s systematic ethnic cleansing of local tribes, other Hindus & other Non-Muslims is being ignored by the authorities knowing fully well that the happenings in Assam are the systematic efforts of Bangla Desh helped by Jehadi elements to create Greater Bangla Desh & socio-politically occupy Assam & many parts of North Eastern Bharat.

Mr. President, coming from Bengal, you are well aware of the plight of Bangla Hindus in Bangla Desh. Kashmir situation has gone out of control & now Assam too going the same direction. Unfortunately, the citizens of Bharat are made into minority there by the invading Bangla Deshi infiltrators (Please see the Annexure – total 9 – attached here for more important details.)

1. Bangla Deshi infiltration is a known fact in Assam. They have settled there with the help of local politicians who have been using this large group as their vote bank. Therefore, the ethnic cleansing by these infiltrators is although not directly state sponsored in a technical terms, but it has a socio-political blessing of those who win based on these votes. (See Annexure 1 & 9)
2. Terror outfits supported by HUJI in Bangla Desh & ISI, Al Qaeda in Pakistan are fully deep-rooted by now in Assam namely like MULTA (Muslim Liberation United Tigers of Assam) & others. (See Annexure 2, 3, 4, 5, 8 & 9). Internationally & even by domestic agencies this has been clearly explained. Yet for vote bank politics, they have been allowed not only enter Bharat, but settle in a sensitive & militarily important state like Assam thereby not only hurting the local population there but putting nation’s safety & security at risk.
3. Despite continued blasts, other jehadi attacks by such groups & the systematic Pak / Bangla Desh sponsored activities like burning big habitats of local tribes, hoisting Pak / Bangla Desh flags, reducing local population to minority by directly killing them & also by adding more to Bangla Deshi Muslim population there by continued illegal influx, both Union Govt & the state Govt of Assam have been claiming that there have been no hand of Bangla Desh in Assam violence. Sir, Mr. President, this is not mere violence between two groups like Bodo & Muslims as both the Govts are trying to project (This refers to the statement given by the Union Home Secretary & also by the CM of Assam on July 26, 2012 that there had not been any hand of Bangla Desh in violence in Assam). This is a systematic Ethnic Cleansing of local age-old tribes & other citizens of Bharat as it happened in Kashmir during partition & around 1990. Similarly, the Govt was in denial about Kashmir regarding Pakistan’s hand in Kashmir Ethnic Cleansing. Today, Pakistan has been responsible for umpteen jehadi attacks in & on Bharat where many innocent lives are lost almost daily in Kashmir & in other parts and this is now the official Govt stand. Therefore, Mr. President, without wasting much time – already it is late -   you in your capacity as the Constitutional Head of the nation & as the 1^st Citizen of Bharat, need to immediately intervene in Assam situation to stop Ethnic Cleansing of local tribes & other original citizens of Bharat there. (Please see Annexure 6 & 9 along with other attached papers & photos)

1. There needs to be immediately formed a Tribunal to deport all Bangla Deshi Muslim Infiltrators from Assam & also from other states in Bharat to prevent further Ethnic Cleansing of Bharat’s own citizens. The tribunal should have members from the Army, those retired & served most part in Assam so that they are well aware of the situation there, the socio-cultural experts to understand the importance of original tribes in Bharat & the legal experts to give justice to all the tribes who have been facing attacks by Bangla Deshis. This tribunal also should set the deadline for time as to until when the Bangla Deshi Infiltrators will be deported fully without getting into the ploy that they have voter ID so they are Bharat’s citizens because for vote bank, many have been given such documents which otherwise are given to Bharat’s other citizens with much verifications.
2. All the local tribes, other Hindus & Non-Muslims who have been attacked over the years & also now staying in Relief camps should be given Ru 7,00,000 minimum compensation for each person in the family died in the violence against them without hassling them for documentation, those who are injured must get immediate medical help at Govt cost & also Ru 4,00,000 as compensation, those who have lost the bread-earner in the family should get – apart from the Ru 7,00,000 compensation – Govt job at least to one member of the family or in case of being illiterate – enough financial aid for agriculture / jungle produce trade / business depending their skills. Govt should also rebuild their houses at the same place where they lived. These facilities should be given ONLY to the local tribes, other Hindus & Non-Muslims.
3. There is no reason other than infiltrators’ invasion for such a big Muslim population there which is the second largest at 31% now – the unnatural growth in population due to systematic heavy influx of Muslim Bangla Deshi Infiltrators from invading Assam’s border districts like Kokrazar, Dhubri, Chirang area & many others. Almost 11 constituencies in Assam, this election, had majority votes of these Muslims. (See Annexure 1, 3 & also other documents attached apart from much more information Govt agencies already would have but are not letting public of Bharat know of it.)
4. Mr. President I urge you NOT to ignore or discard my letter, the information attached & also the pleas made by all of us about Assam to immediately deport ALL Bangla Deshi Muslims there. Please do not discard these merely because we may differ in some parts of ideologies. But as a patriotic 1^st Citizen of Bharat, YOU and those who do care for keeping Bharat safe from Bangla Desh’s & Pakistan’s shrewd & horrible invasions – WE, all together can make a difference if we keep our some differences aside when it comes to such national issues. We all are more than willing to extend our helping hand, however small that help may be, to you if & when you take up the issues of national security & local population’s safety in Assam & in all such troubled states rising above any political compulsions.

In your new tenure as the President of Bharat, we wish you all the best & again urge you to intervene in the Human Rights crisis created by Ethnic Cleansing of original tribes, other Hindus & non-Muslims in Assam. Kindly do take out time from your busy schedule to go through the documents attached to this letter to get a glimpse of the huge security threat from bordering countries to North East & therefore to Bharat. Original people of Assam – the citizens of Bharat – are waiting for you to show your kind heart & diplomatic acumen in saving them from the modern day invasion from Bangla Desh & Pakistan. Be their savior in their agony & pain, Mr. president, so that citizens of Bharat in other states would not have to nationally & internationally raise such issues but focus of taking Bharat to newer heights.

Having allocated more than 2000 Cr. budget for minority development (almost 81% hike in minority welfare in UP Budget-2012) ,Samajwadi Party disbursing all development fund to muslims only and shamelessly distributed crores of rupees to the family of rapist of Asthana-Kunda wounding not only the poor mother of the girl raped and killed but the whole 90 Crore Hindus of this country.
15 Cr muslims of this country are in the role of Gunda-gardi dancing over the head of 90 Cr hindus of the nation at behest of such political parties.

Within a few month of its rule, Samajwadi Party has blessed two major communal riots in UP and instead of prosecuting Dangai and rapist ;the hardcore muslims ,rewarding ,appeasing and protecting them by sending jail innocent victim -hindus in fake FIR who really have no relation with the incidents.

In Asthana –Kunda riots ,4 muslim families of rapists were told as 45 separate family (actually all 45 members were part of these 4 families) and crores of helping fund disbursed to all 45 muslim members separately.
Surprisingly ,secular leaders and media are out of the scene to cover and comment on the report and our useless PM who is Rajyasabha Member from Aasam enjoing flattery blessed chair keeping mum over the havoc and barbaric incidence as usual.

Prez Poll:Hunt of a Pet not The Patriarch

After rollback of Mulayam Singh leaving Mamta Banerjee chastened; a fickle character of all regional parties having permutations of their seeded interest with central government and a part of political pragmatism, now UPA with dithered rebellious allies is on the go to fill the Prez Post with another party pet to play a mute role and to be duty bound to the UPA’s ill wishes.

The similar way ,the State governors are appointed to work at behest of central government and the ultimate flattering foes are deputed with the charge so as to carry on their loyalties to the ruling party, Presidential Post ;chief of all such sycophant Yes –Mans have become contagious now.

A dignity post has now become a departmental vacancy to execute the task assigned under the blessings of the patron party or to keep mum over the ill doings of the ruling government.

Now, the two representative of the country –President and Prime-minister are supposed to deliver highly elaborative illusive speeches on Independence and Republic day only written by their respective advisors; the intent and content of which have no relation with the facts and reality.

Thus the duo dignity- turned-fiduciary posts are now meant to certify and authenticate the wrong doings of the ruling party and to work like the Spoke-persons of the mentor political party at center.

Satisfied with the flattery of Pratibha Patil for which she was coroneted and no-body knows what worth she did during her tenure, hunt of new pet is further effort to traditionalize this flattery culture to be at party’s beck and call ;a must feature of Indian polity and beaurocracy.   

Kosikalan Riots: Recurrence of Islamic fanatics at behest of Samajwadi Party

The riot ravaged hose of my friend CA Robin Garg and the ashes of burnt properties of Hindus and local authority /institutions in Kosikalan covering the whole locality into grip since yesterday is at the verge to become next Godhra.

In the very familiar way this time too the flame of hatred and bloodshed was started by the handful hardcore fanatical Muslim groups over the minute issue of touching the drinking water by a Hindu youngster leading dispute and the massive destruction of revenge aftermath.

Take history as evidence of the riots in India which made victim every time the patient Hindu majority and if we leave other part of India and talk specially about UP, Communal riots are the virtues of Samajwadi Party government which protects and nurtures the seeded blood wishes of Islamic hardcore groups in lieu of the assurance of The party’s electoral manifesto to promote the divisive interest of minority groups.

Kosikalan Roits is being protected by State ruling party in the similar way they protected Gorakhpur Riots, Mau (Azamgarh) Riots with leadership of infamous Mukhtar Ansari(SP Leader) in 2005 where thousands of Hindu hoses were burnt afire and Hindu women’s were raped and killed by local Islamic groups with full support of Mulayam Singh; the then CM of UP.

Although, in the licking atmosphere of Muslims by almost all political parties to appease muslims and specially SP in UP; it is hard to believe that Kosikalan victims will get justice and their ravaged property will be compensated as against the situational muslim victims of such riots who have prerogative to such compensation in every part of the country.   

Samajwadi Party with great track record of protecting communal riots by hardcore muslim groups is again at the bent to islamic berserk; The terror minded anti-nations.

Let the riot be in control (and we hope maulana Mulayam and mohammad Akhilesh Singh, having a bit faith in sovereignty will try to curb the growing rage)and after that it will be interesting how pseudo secular parties interpret and manipulate the issue and no doubt start to blame the flame of riots on RSS or other saffron groups.

LAC & LOC: Border of enemies Harbour –Blessings of INC

The prosperity and growth of a country without giving importance to security threats get abolished in post management of damages caused by intruders of security. And it becomes a serious concern to a country with lacks of disputed kilometre of border fence with permanent neighbouring enemies. 

Having already lost 16,000 sq. KM of J&K (Now POK) and around 36,500 sq. KM (plus 5500 Sq KM friendly donated by Pakistan to china) to Pakistan and china respectively (illegally occupied by these two enemies), we are at the door step to lose more by allowing them to trespass due to lack of political courage and ceded political ambition.

 

The decades of ongoing terrorism war; crossed the border fence and registered its presence on Parliament, Hotel Taj and blessed innumerable serial blasts all over India, is enough to describe the havoc of security threats which swallowed lacks of people’s live (except those innocent life which we lost during partition of Pakistan and Bangladesh) ,thousands of security officers and Jawans as a cost of protection other than the multibillion monetary fund of countrymen. And how many lacks more we will lose is to be answered by government only.

Where at one side Nepal, which now a days has become an easy gateway to invaders due to Maoist and their growing relations with Islamic terror outfits ,on the other the continuous transgression movement of Pakistan and China eying to our border from all dimensions (North-east,Middle,Western)having already occupied illegally thousands of kilometre of India in Western and North – East ; posing a serious question on the will of congress government who are still carrying and nurturing the ill-will of their fore-fathers and thrown us today at the verge of this apparently incurable disease of  almost 65 years old. 

The repetitive revelation of Chinese PLA’s (People’s liberation Army)violation over LAC (4057 KM Actual line of Control area )with clear intent of cartographic aggression in India through an aggressive border management policy to stake claim to disputed areas in all the three sectors-western (Ladakh),middle(Uttarakhand & Himanchal Pradesh )and eastern (Sikkim,Arunanchal Pradesh) is not new but the furtherance of the Chinese strategic intrusion continued since 1962 and government don’t take this transgression (over 500 times in immediate last years )activity as border threat.(Times of India; May 17’th 2012)

Keeping mum on the abolition of distributive Article of constitution -370 and flaring the voices of small no of separatist (limited only in small area of J&K-Baramula,Srinagar,Pulwama , Anatnag and Shopian covering 14% area of Kashmir valley),allowing free movement of terrorist leaders Mirwayze & Geelani all over in India to camp and organise seminar is nothing but the betrayal culture of congress of creating an atmosphere around the world that J&K solution rests in its autonomy (so called “Azadi” of separatist) and not in the Indian sovereignty and this is the reason that last year the group of interlocutors( Dilip Padgaonwaker ,Radha Kumar and MM Ansari)have voiced the same tune of seclusion that Kashmir resolution can’t be done without the involvement of Pakistan and this is despite the commitment of the then government of India in parliament on 14^th November 1962 and duly passed proposal in Sansad of 22^nd February 1994 that “we’ll certainly take back the area illegally occupied by china(1962) and Pakistan(1947) and no government can compromise on this issue”.

Denying to be part of the Union is because of the ceded interest of Omar, Farukh and Mufti to trap Muslim voters in hand and to keep on ruling in the state without intervention of Indian government and to not to lose Muslims voters across the country congress favours this betrayal will of anti national leaders (of course our Muslim population is just a vote bank of these parties in India and probably they themselves don’t want to get over from this tendency).

International interest (as proved by the revelation of captured terrorists that intrusion and terror activity are being financed by various foreign nations to Pakistan and Pakistan supported Jihadi groups) in J& K is because of the POK region (Gilgit-Valtistan;of 63,000 sq KM adjoining 5 countries with India namely Pakistan,Afganistan,Tajakistan,China and Tibet )which links Middle Asia to south Asia and a very important central place to maintain control all over in Asia. And USA’s dubious character on this disputed issue is only because of this so as to control the key in hand. 

China’s growing activity in illegally occupied Tibet by preparing airbases and laying network of railway lines and illegal intrusion to laddakh and North-East border are serious threats to India other than existing problem of Islamic invaders through Pakistan,Bangaladesh & Nepal.
